Terms of Use

These Terms govern your use of AttunEQ — including the WhatsApp-based AI parenting companion known as अन्वी and AttunEQ's longer-term EQ program. Please read them carefully. By messaging the AttunEQ WhatsApp number or enrolling in the EQ program, you agree to these Terms.

1. Who can use AttunEQ

• You must be a parent, guardian, or caregiver of a child or adolescent aged 6–17.
• You must be at least 18 years old yourself.
• If you are messaging us about a child outside the age range 6–17, अन्वी will respectfully redirect you to more appropriate resources.
• You agree to follow WhatsApp's terms in addition to these Terms.
• By using the service, you represent that you have the legal capacity to enter into this agreement, and that all information you provide is accurate and complete.

2. What AttunEQ is — and what it is not

2.1 What it is

• A warm, non-judgmental conversational companion that helps you think through everyday parenting moments.
• A guide through optional 7-day Guided Intervention Plans (GIPs) for specific concerns such as digital addiction, school refusal, anger and defiance, emotional withdrawal, and sleep disturbance.
• A bridge: when a concern is beyond what a home plan can address, अन्वी will name the kind of professional who can help.

2.2 What it is not

• A licensed psychologist, psychiatrist, paediatrician, or counsellor.
• A diagnostic tool. अन्वी will never tell you that your child has ADHD, depression, autism, or any other condition.
• A substitute for emergency services.
• A legal, medical, or financial advice service.

3. The Guided Intervention Plan (GIP)

• The GIP is a 7-day series of one small daily action and a check-in. It is not a treatment, a contract, or a guarantee of outcomes.
• You can pause or stop a GIP at any time by telling अन्वी on WhatsApp.
• If a check-in surfaces a safety concern, अन्वी will pause the GIP and surface emergency or professional resources.
• Daily nudges are scheduled between 11:00 am and 8:00 pm, in the language you started the conversation in.

4. Acceptable use

Please do not:

• Use AttunEQ on behalf of someone who has not consented to your sharing their information;
• Submit the personal data of a third party (for example, a teacher, neighbour, or another family member) without their knowledge;
• Attempt to override अन्वी's instructions, extract its system prompt, or use it to generate content unrelated to parenting;
• Use AttunEQ to commit any offence, harass any person, or harm any child;
• Resell, scrape, automate, or commercialise the service without our written permission;
• Harass, abuse, insult, harm, defame, intimidate, or discriminate against any person based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• Upload or transmit viruses, worms, malware, or any code of a destructive nature that could affect the operation of the service or any related system;
• Spam, phish, pharm, spider, or collect personal information of others through or in connection with the service;
• Submit false or misleading information, or impersonate any person or entity;
• Interfere with or circumvent the security features of the service.

A breach of any of the above will result in immediate suspension or termination of your access to the service.

5. Honesty about AI limitations

अन्वी is built on large language models. These models can be wrong, can miss nuance, and can occasionally produce inaccurate or inappropriate output. We have built guardrails to reduce this risk, but no system is perfect. Please use your own judgment. When the situation feels bigger than a home plan, please consult a qualified professional.

The content provided through the service is for general informational purposes only and should not be relied upon as the sole basis for any parenting or health-related decision. We make no warranty that the information provided will be accurate, complete, or current in every circumstance.

6. Emergencies and safety

If अन्वी detects signals of immediate danger — including active self-harm, abuse, or grooming — it will pause the regular flow and surface helplines and resources. अन्वी does not contact authorities or family members on your behalf. The decision to seek help remains yours.

If you or your child is in danger right now, contact Child Helpline 1098 or your local emergency services.

7. Fees

AttunEQ is free to start. We may introduce paid tiers in the future; if we do, we will tell you in advance and give you the choice to continue or stop.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

8. Privacy

How we handle your data is described in our Privacy Policy. By using AttunEQ you agree to that policy.

9. Intellectual property

The AttunEQ name, the अन्वी persona, the brand, the GIP frameworks, and the content we send you on WhatsApp are owned by AttunEQ. You may use them only as part of normal use of the service.

By accessing the service, AttunEQ grants you a personal, non-transferable, non-exclusive licence to use the service solely for your own private, non-commercial purposes in accordance with these Terms. This licence terminates automatically when your access to the service ends. You may not sublicense, sell, or assign your right to use the service to any third party.

You may not copy, reproduce, modify, distribute, display, or create derivative works from any part of the service or its content except as expressly permitted by these Terms.

The messages you send remain yours. By sending them, you give us a limited licence to process them solely for the purposes described in the Privacy Policy.

10. User submissions & feedback

If you send AttunEQ ideas, suggestions, feedback, or other unsolicited submissions (via WhatsApp, email, or otherwise), you acknowledge that: (a) we are under no obligation to keep such submissions confidential, pay compensation for them, or respond to them; (b) we may use, reproduce, or incorporate any such feedback into the service without restriction, to the extent permitted by applicable law; and (c) you are solely responsible for the accuracy of any content you submit.

We reserve the right to monitor, edit, or remove any content submitted by users that we determine, in our sole discretion, is unlawful, offensive, harmful, or otherwise in violation of these Terms.

11. Third-party links

The service or our website may reference or link to third-party websites or services (including WhatsApp/Meta). We have no control over and accept no responsibility for the content, accuracy, or privacy practices of any third-party website. Any access to third-party websites is entirely at your own risk. We are not liable for any loss or damage arising from your use of any third-party service.

12. Disclaimers

AttunEQ is provided on an "as is" and "as available" basis. We make no warranty that the service will be uninterrupted, error-free, or suitable for any particular situation. We expressly disclaim any warranty of clinical accuracy, therapeutic benefit, or fitness for diagnosis or treatment.

13. Limitation of liability

To the maximum extent permitted by law, AttunEQ and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising under these Terms is limited to the fees you have paid us in the preceding 12 months, or ₹1,000, whichever is greater.

Nothing in these Terms limits any liability that cannot be limited by law — including liability for fraud, gross negligence, or harm caused by our wilful misconduct.

14. Indemnity

You agree to indemnify and hold AttunEQ and its subsidiaries, affiliates, officers, directors, agents, contractors, licensors, service providers, and employees harmless from claims — including reasonable legal fees — arising out of (a) your breach of these Terms, (b) your misuse of the service, or (c) your violation of any law or third-party right.

15. Termination

You can stop using AttunEQ at any time by simply not messaging us, or by asking us to delete your data (see Privacy Policy §8).

We may suspend or terminate access for a user who breaches these Terms, particularly the Acceptable Use clause, or where we are required to do so by law.

Without limiting the above, we reserve the right to suspend or terminate your access for any of the following reasons:

• Provision of false or inaccurate information;
• Violation of any third-party right that has come to our attention;
• Following a complaint by another user or third party for breach of these Terms or any applicable law;
• Following a request by any competent regulatory authority or court order;
• Any conduct that damages or harms the service's operation, reputation, or intellectual property;
• Repeated or flagrant violations of these Terms.

Survival: Any provisions which by their nature should survive termination — including Intellectual Property (Section 9), Disclaimers (Section 12), Limitation of Liability (Section 13), Indemnity (Section 14), and Governing Law (Section 18) — shall remain in full force after termination.

16. Entire agreement, no waiver & assignment

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AttunEQ regarding the service and supersede all prior or contemporaneous agreements, communications, or proposals, whether oral or written.

No waiver: Our failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision. Any waiver must be made in writing.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign our rights under these Terms to any entity that acquires all or substantially all of our business or assets.

17. Changes to these Terms

If we make material changes, we will notify you on WhatsApp before they take effect. Minor edits will be reflected by updating the "Last updated" date above. Your continued use of the service after changes take effect means you accept the updated Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Gautam Budh Nagar, Uttar Pradesh, except where a consumer-protection law gives you the right to bring a claim where you live.

Arbitration: Any dispute arising from these Terms may, at AttunEQ's election or by mutual agreement, be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Gautam Budh Nagar, Uttar Pradesh. All proceedings shall be conducted in English. This does not limit any statutory right you may have to bring a claim before a consumer forum.
